Terms & Conditions
Effective date: 27 October 2026
These terms govern the use of Where Is My Driver (the web panel, the driver app and this website, together the “Service”), provided by DARVIK INNOVATIVE PRIVATE LIMITED (“CargoRoot”, “we”, “us”). By creating an account, signing in, or using the Service, you agree to these terms. If you use the Service for a business, you agree to them on that business’s behalf and confirm you are authorised to do so. How we handle personal information is described in our Privacy Policy.
1. The Service
Where Is My Driver helps transport and logistics businesses (“Customers”) plan and track trips through their drivers’ phones, keep records of their vehicles and drivers, collect proof of delivery, and look up vehicle, licence, FASTag, challan, e-way bill and GST information through authorised data providers. Features available to an account depend on what has been switched on for it and on the credits it holds. We may improve, change or retire features over time; where a change significantly reduces what a Customer has paid for, we will tell them in advance.
2. Accounts
- Accounts are created by us for a Customer, or by a Customer’s owner for their team. Each user must have their own sign-in and must keep their password secret.
- The Customer is responsible for everything done under its account, for the people it adds, and for keeping its business details accurate.
- Tell us straight away at info@cargoroot.com if you believe an account has been used without permission.
3. Drivers and their data
- Customers must tell their drivers that their location will be shared for the duration of each trip they start, and must have a lawful basis for tracking them and for the information they enter about them.
- Driving licence checks may only be made with the driver’s consent, which the Customer must obtain and which the Service records with each check.
- Customers must not use the Service to track anyone outside a work trip, or to collect information they are not entitled to. The driver app collects location only during an active trip, as described in the Privacy Policy.
4. Credits, payments and GST
- The Service is pay as you go. Trips use trip credits and data checks use lookup credits, as shown in the panel and on our Pricing page. Prices are shown before GST; GST is charged as applicable and shown on the invoice.
- Credits do not expire while the account is active. They are for use on the Service only, cannot be transferred to another account and have no cash value.
- A trip cancelled before a driver accepts it returns its credit. A check that the data provider fails to answer costs nothing, and the same check repeated within 10 minutes is free. A check that is answered, including an answer that no record was found, uses a credit.
- Online payments are processed by our payment provider; we do not see or store card or bank details. Credits are added once the payment provider confirms the payment.
- Purchases of credits are not refundable once made, except where the law requires it or where we agree to a refund (for example, a duplicate payment). When we refund a payment, we may also remove the credits it bought, even if that leaves the balance below zero; a balance below zero is owed and is covered by the next purchase.
5. Government and third-party data
- Vehicle, licence, FASTag, challan, e-way bill and GST information comes from authorised data providers and public systems. We pass it on as received; we do not create it and cannot guarantee that it is complete, current or available at every moment.
- The Service is not affiliated with or endorsed by any government body. Results are an aid to the Customer’s own checks and decisions, not a certificate or official verification.
- Location shown from sources other than a driver’s phone, such as toll-passage events or network-based estimates where available, is approximate and labelled as such.
- Customers must use looked-up information only for legitimate business purposes and in line with the law.
6. Acceptable use
You must not:
- use the Service for anything unlawful, or to harass, stalk or monitor anyone without a lawful basis;
- enter information you have no right to use, or false information about vehicles, drivers or trips;
- try to break into, overload, copy, resell or reverse-engineer the Service, or get around its limits or credit charges;
- share tracking links or looked-up information beyond the people who need them;
- use automated scripts to send demo requests or to call the Service, other than through features we provide for that.
7. Suspension and closing an account
- We may suspend or close an account that breaks these terms, puts the Service or others at risk, or has amounts owed that remain unpaid after notice. While suspended, an account can still be viewed but not used to create trips or make checks.
- A Customer may ask us to close its account at any time by writing to info@cargoroot.com. Data is then deleted as described in the Privacy Policy.
- Unused credits on a closed account are not refunded, unless we agree otherwise or the law requires it.
8. Our content and yours
- The Service, its software, design and content belong to us or our licensors. We give each Customer a limited, non-transferable right to use it under these terms.
- Customers keep all rights in the information they put into the Service. They give us permission to store and process it only to provide the Service to them, as described in the Privacy Policy.
9. Availability
We work to keep the Service available and reliable, but it depends on mobile networks, drivers’ phones and settings, and outside providers. We do not promise that it will be uninterrupted or error-free, and planned maintenance may occasionally make parts of it unavailable.
10. Responsibility and liability
- The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim warranties not stated in these terms, including fitness for a particular purpose.
- To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits, lost goods, delays or penalties) arising from use of the Service or from information provided by third parties.
- To the extent the law allows, our total liability for any claim relating to the Service is limited to the amount the Customer paid us in the twelve months before the claim arose.
- The Customer will compensate us for claims made against us by others that result from the Customer’s breach of these terms or unlawful use of the Service, including tracking or checking people without a lawful basis.
11. Changes to these terms
We may update these terms. We will change the effective date above, and for significant changes we will tell Customers in the web panel or by email before they take effect. Continuing to use the Service after that means accepting the updated terms.
12. Law and disputes
These terms are governed by the laws of India. We will try to resolve any dispute by talking first; please write to info@cargoroot.com. Disputes that cannot be resolved that way are subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
